By creating an account or using the service you agree to these terms. If you are agreeing on behalf of a team or brokerage, you confirm you are allowed to bind that organization.

What the service is

AgentsWise provides hosted websites, listing display, lead capture, client follow-up, and related tools for real estate professionals. Features differ by plan, and we may add, change, or retire features over time.

Your account

You must give accurate registration details and keep your credentials secure. You are responsible for activity under your account. Tell us promptly at [email protected] if you believe it has been compromised.

Plans, billing, and cancellation

Paid plans are billed in advance on the cycle shown at checkout. Prices are in Canadian dollars and exclude applicable taxes unless stated otherwise.
Subscriptions renew automatically until cancelled. You can cancel at any time and your plan stays active until the end of the paid period.
Except where required by law, payments already made are non-refundable.
A free plan may be offered with reduced limits, and we may change what it includes.
Some listing data feeds carry board or association fees that are billed separately by those organizations.

Your content

You keep ownership of everything you upload — text, images, listings, and client data. You grant us the licence needed to host, display, back up, and deliver it as part of running the service. You are responsible for having the rights to what you publish, including photography and listing content.

MLS, IDX, and VOW responsibilities

This part matters in our industry. Access to board or MLS listing data is governed by your real estate board or association, not by us. You are responsible for holding the required membership and for signing and complying with the applicable IDX or VOW data-access agreement, including rules on display, attribution, sold data, and registration. We will help you configure an approved feed, but we cannot grant access, and we are not responsible for a board suspending or refusing a feed.

Acceptable use

Do not use the service to break the law, infringe someone's rights, send messages that contravene anti-spam legislation, publish misleading listing information, attempt to breach our security, or resell the platform without our written agreement.

Communications you send

If you use our email or SMS tools, you are the sender. You are responsible for having valid consent from the people you contact and for honouring unsubscribe requests.

Availability

We work to keep the service running and to give notice of planned maintenance, but we do not promise uninterrupted or error-free operation. The service is provided "as is" to the fullest extent the law allows.

Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, including lost profits, lost business, or lost data. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing here excludes liability that cannot legally be excluded.

Suspension and termination

You may close your account at any time. We may suspend or end an account that breaches these terms, does not pay, or puts the platform or other customers at risk. Give yourself time to export your content before closing an account, as data may be deleted afterwards.

Changes to these terms

We may update these terms. We will change the date above and, for significant changes, notify account holders. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction.

Language

These terms are available in English and French. The English version governs; the French version is provided for convenience. If the two versions differ, the English version applies.
